Prohibition on acceptance of deposits from public

📚 Law Minded summary

A company cannot take deposits from the general public. This is the section that closes that door.

A private company may accept deposits from its own members, and only after a long list of conditions: a circular to members, a copy filed with the Registrar, a deposit repayment reserve holding at least twenty per cent of the deposits due next year, deposit insurance, and a certificate that the company has not defaulted before.

It also has to disclose any past default. The point is to stop unregulated deposit-taking dressed up as company finance.
